Guidelines to holding AMUS Assembly
Article 16, paragraph (1) of the Law on Associations and Foundations of Bosnia and Herzegovina stipulates that the Assembly is a mandatory body of the association. The statute of the association, as the highest general legal act of the association, defines the bodies of the association, the way they are elected, the powers they have, the quorum and voting rules, the duration of the term, etc.
Article 21 of the AMUS Statute provides for the procedure for convening the Assembly, the manner in which the quorum is to be determined and the manner in which decisions are taken. Therefore, all guidelines for holding an AMUS Assembly session are contained in the AMUS Statute (No. 01/16 of February 15, 2016) and it is necessary to adhere to them consistently.
These provisions cannot be derogated from acts of lower legal force, such as the Rules of Procedure of the Assembly.
Considering that the Ministry of Justice of Bosnia and Herzegovina issued three decisions (dated 23/09/2019, 01/10/2019 and 29/01/2020), it is necessary to correct all irregularities stated in the decisions in question when convening the Assembly and adopting decisions thereon.
- Decision of the Ministry of Justice of BiH No. UP09-07-1-673/19, dated 23/09/2019
- Decision of the Ministry of Justice of BiH No. UP09-07-1-89/19, dated 01/10/2019
- Decision of the Ministry of Justice of BiH No. UP09-07-1-2250/19, dated 29/01/2020
Given that the term of office of the AMUS governing bodies has expired, it would be a priority to elect new members of the Association's bodies.
Also, it is necessary to comply with the decisions of the Institute for Intellectual Property of BiH regarding AMUS obligations under the Law on Collective Management of Copyright and Related Rights.
