Information for AMUS members and the public on the judgments of the Court of BiH
Mostar, October 26, 2020 - The Institute for Intellectual Property of Bosnia and Herzegovina received on October 26, 2020 two judgments of the Court of Bosnia and Herzegovina (number: S1 3 U 032160 19 U and S1 3 U 032162) rejecting the lawsuits of the Association of Composers - Music Makers (AMUS) filed against the decisions of the Institute ordering measures to eliminate the observed irregularities in the work of AMUS.
With these judgments, the Court of BiH confirmed that the decisions of the Institute for Intellectual Property of BiH are based on a correctly established factual situation, proper application of the rules of procedure and proper application of the law.
We especially emphasize the position of the Court of Bosnia and Herzegovina regarding the adoption of documents provided for in Article 20 of the Law on the Collective Management of Copyright and Related Rights, where it was concluded that these acts must be adopted at regular sessions of the AMUS Assembly and not by electronic voting of AMUS Assembly members.
