Institute for Intellectual Property of BiH implements CP3 project

 

Mostar, December 1, 2021 - Institute for Intellectual Property of Bosnia and Herzegovina is implementing the CP3 project related to the Common Practice important for the distinctiveness of figurative marks containing descriptive / non-distinctive words.

Institute for Intellectual Property of Bosnia and Herzegovina has published a Document on Common Practice in Cases in which the figurative mark, which contains descriptive / non-distinctive words, satisfies the conditions of examination of absolute grounds because the figurative element gives the mark as a whole sufficient distinctive character.

Practice Paper is the result of cooperation between the Institute for Intellectual Property of Bosnia and Herzegovina and EUIPO, as part of international cooperation activities, with the aim of further increasing transparency, legal certainty and predictability for the benefit of examiners and users.

The Paper is divided into two parts: the first part summarizes the criteria, and the second part provides an explanation of the criteria.

The Joint Practice Paper is available in English, Bosnian, Croatian and Serbian.
